    The reason for this is that they are considered a diagnostic test, for the purposes of determining whether or not you are affected by a particular condition. Just as a home pregnancy test would be an eligible FSA expense, so also would be an at-home drug test.

    The home drug test kit must be purchased for use on a family member or other person covered by your FSA, and it is possible that your specific FSA could exclude a home drug test kit if your employer’s plan document is more restrictive than the federal guidelines, but unless there’s some provision in your employer’s plan that excludes it, the IRS recognizes it as a diagnostic test, and therefore it would be covered.
